1. KVKK Privacy Notice

(Privacy notice under Turkish Law No. 6698 on the Protection of Personal Data)

1.1. Data Controller

Under Turkish Law No. 6698 on the Protection of Personal Data (“KVKK”), your personal data is processed by İkon Proje Dan. Mim. Müş. San. Tic. Ltd. Şti. in the capacity of data controller, within the scope described below.

1.2. Purposes of Processing

  • Receiving and responding to your enquiries
  • Carrying out residential and real estate sales and marketing processes
  • Establishing and performing contracts
  • Conducting marketing, advertising and campaign activities (with explicit consent)
  • Where you consent, sending commercial electronic messages by e-mail, SMS and telephone, and reporting these consent and opt-out records to the Turkish Message Management System (İYS) as required by law
  • Measuring and improving website performance
  • Fulfilling legal obligations and providing information to competent authorities
  • Your explicit consent (Art. 5/1) — in particular for marketing and targeting cookies, sending commercial electronic messages and transfers abroad
  • Necessity for the establishment or performance of a contract (Art. 5/2-c)
  • Compliance with a legal obligation of the Company (Art. 5/2-ç) — including İYS notifications
  • Necessity for the legitimate interests of the Company, provided that the fundamental rights and freedoms of the data subject are not harmed (Art. 5/2-f)

1.4. Transfer of Personal Data

Your personal data may be transferred for the purposes above and in accordance with the conditions set out in Articles 8 and 9 of the KVKK to: our service providers (hosting, e-mail/SMS delivery infrastructure, CRM, analytics), advertising and analytics partners (Meta, Google), the Message Management System (İYS) for the notification of consent and opt-out records for commercial electronic messages, and to legally authorised public institutions. Where a transfer abroad is involved (for example advertising, analytics and communication services with servers located outside Türkiye), the transfer is carried out within the conditions of Article 9 of the KVKK and, where required, on the basis of your explicit consent.

1.5. Method of Collection

Your personal data is collected by wholly or partly automated means through: forms on the website, promotional and enquiry forms (lead forms) published on advertising platforms such as Meta (Facebook/Instagram) and Google, cookies and similar tracking technologies, telephone, WhatsApp, e-mail and face-to-face meetings. Information you submit through advertising platform forms is transmitted to us securely by the relevant platform and processed within the scope of this notice.

1.6. Rights of the Data Subject (Art. 11 KVKK)

  • to learn whether your personal data is being processed
  • to request information if it has been processed
  • to learn the purpose of processing and whether the data is used in accordance with that purpose
  • to know the third parties in Türkiye or abroad to whom the data has been transferred
  • to request correction if the data has been processed incompletely or inaccurately
  • to request erasure or destruction
  • to request that corrections and erasures be notified to the third parties to whom the data was transferred
  • to object to an outcome to your detriment arising from analysis carried out solely by automated systems
  • to claim compensation if you suffer damage due to unlawful processing

1.7. How to Apply

Your applications are concluded within 30 days at the latest. If the process requires an additional cost, the fee set by the Turkish Personal Data Protection Board may be charged.

2. Explicit Consent Statement

The identity and contact details (name and surname, telephone, e-mail) you share through the contact and enquiry forms on our website and through promotional and enquiry forms (lead forms) published on platforms such as Meta (Facebook/Instagram) and Google, together with your preferences regarding the project you are interested in, may be processed for the purposes of marketing, promotion, campaigns, profiling/segmentation and satisfaction measurement.

Data within this scope may be transferred only for the purposes above and in accordance with Articles 8 and 9 of the KVKK to our service providers (e-mail/SMS delivery infrastructure, CRM, analytics) and to advertising and analytics partners (for example Meta, Google). Because the servers of these service providers are located abroad, your explicit consent also covers the transfer of your data outside Türkiye.

Within the scope of your explicit consent, your contact details may also be uploaded to the Meta and Google advertising platforms in hashed (encrypted) form, in order to create custom and lookalike audiences so that more relevant advertising can be shown to you and to users with a similar profile.

You may give the statement “I accept the processing and transfer of my personal data within the scope described in the Explicit Consent Statement” by ticking the relevant box in the forms on our website, or by accepting the consent statement in the forms on advertising platforms.

You may withdraw this consent at any time and without giving any reason by contacting info [at] ikonproje.com. Explicit consent applies to processing that is not required for the establishment or performance of a contract or for legal obligations; if you withdraw it, processing within that scope is stopped.

3. Commercial Electronic Message Consent

This section is the information and consent text for commercial electronic messages to be sent under Turkish Law No. 6563 on the Regulation of Electronic Commerce, the Regulation on Commercial Communication and Commercial Electronic Messages, and related legislation.

If you give your consent, commercial electronic messages may be sent to you by e-mail, SMS, telephone call and WhatsApp for the purposes of information, promotion and marketing about new projects, campaigns, prices and opportunities. Messages may also be sent through service provider (intermediary) firms on behalf of İkon GYO.

  • by ticking the box “I accept receiving commercial electronic messages” in the forms on our website,
  • by ticking the consent box or accepting the consent statement in promotional and enquiry forms (lead forms) published on platforms such as Meta (Facebook/Instagram) and Google,
  • by giving written or electronic consent at our sales office or through other channels.

Consents given through advertising platform forms also constitute valid commercial electronic message consent within the scope of this text.

3.3. İYS Registration

Your consent and opt-out records for commercial messages are registered in the Message Management System (İYS) as required by law. You may view and manage your consents through İYS (iys.org.tr).

3.4. Withdrawal of Consent (Right to Refuse)

You may refuse to receive commercial electronic messages at any time, without giving any reason and free of charge:

  • by using the “unsubscribe” link in our e-mails,
  • by using the refusal method stated in SMS messages,
  • through İYS (iys.org.tr),
  • or by contacting info [at] ikonproje.com.

Your refusal is processed within the period prescribed by law and message delivery is stopped.

4. Privacy Policy

4.1. Introduction

İkon GYO values the privacy of users who visit the ikongyo.com website (the “Site”). This section explains which personal data is collected through the Site and our advertising channels, how it is used and how it is protected.

4.2. Data We Collect

  • Contact and enquiry form data: name and surname, telephone number, e-mail address, the project you are interested in and the content of your message.
  • Advertising platform form data: name and surname, telephone, e-mail and preference information you submit through promotional and enquiry forms (lead forms) on platforms such as Meta (Facebook/Instagram) and Google.
  • Automatically collected data: IP address, browser type, pages visited, date and duration of the visit, referring site (via cookies — see the Cookie Policy).
  • Information sent through communication channels: details you share with us by telephone, WhatsApp or e-mail.

4.3. Sharing of Data

  • Service providers: site hosting, e-mail/SMS delivery infrastructure, CRM and analytics providers
  • Advertising and analytics partners: platforms such as Meta (Facebook/Instagram) and Google (within the scope of cookies/tracking technologies and advertising forms, and subject to your consent)
  • Message Management System (İYS): notification of consent and opt-out records for commercial electronic messages as required by law
  • Competent public institutions: where there is a legal obligation

Your personal data is never sold to third parties for marketing purposes.

4.4. Retention and Security of Data

Your personal data is retained for the period required by the purpose of processing and for the statutory retention periods set out in the relevant legislation; at the end of these periods it is deleted, destroyed or anonymised. Appropriate technical and administrative measures are taken to protect your data.

5. Cookie Policy

Cookies are small text files saved to your browser when you visit a website. They are used to ensure the site works properly, to analyse usage habits and to offer you more relevant content and advertising.

We use the following third-party technologies for advertising and analytics purposes. These cookies are activated only with your explicit consent:

  • Meta Pixel (Facebook/Instagram): to measure your site visits, evaluate advertising performance and show remarketing advertisements.
  • Google Analytics: to analyse site traffic and user behaviour.
  • Google Ads: to measure advertising conversions and for remarketing.
